The petitioner is accused in connection with Chandradeep P.S. Case No. 52 of 2015, registered under Sections 302 and 387/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that three persons named in the F.I.R. including the petitioner reached at the house of the informant and started abusing to the informant and made demand of ransom of Rs. Two Lakhs with threatening to kill him in case of not paid the ransom. At that time, the brother of the informant, namely, Arun Kumar was shot fire by the accused persons. Learned counsel appearing on behalf of the petitioner submits that there is general and omnibus allegation

Patna High Court Cr.Misc. No.9635 of 2016 (3) dt.28-04-2016 2/2 against the petitioner and two others named that they shot fire at the deceased due to non-fulfillment of demand of ransom, but it would appear from the case diary vide para 26 and 27 that coaccused Amarjeet Singh shot fire at the deceased. Further submission is that while petitioner is accused in Kikandra P.S. Case No. 55 of 2015 registered under Section 307/34 of the Indian Penal Code, but he is on bail in that case. Further submission is that the similarly situated co-accused Ankaj Kumar has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 08.02.2016 passed in Criminal Misc. No. 52205 of 2015. The petitioner is in custody in the present case since 08.01.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, J.M.1st Class, Jamui in connection with Chandradeep P.S. Case No. 52 of 2015.
