Patna High Court MJC No.593 of 2017(4) dt.25-11-2024 2/2 arising out of C.W.J.C. No.10454 of 1992.

2. Due to error committed by Advocate- on- record, litigants should not be penalized. Therefore, the order dated 24.01.2017 passed in L.P.A. No.1729 of 2015, arising out of C.W.J.C. No.10454 of 1992, is recalled and the present M.J.C. No.593 of 2017 stands allowed. L.P.A. No.1729 of 2015 is restored to its original file and number.

3. Registry is hereby requested to list L.P.A. No.1729 of 2015 before the concerned Roster Bench at the earliest.

4. The present M.J.C. No.593 of 2017 stands allowed subject to payment of cost of Rs.3000/-(Rupees Three Thousand). Cost shall be remitted in the Patna High Court Legal Services Authority within a period of four weeks from today.
