The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 399, 402, 412 of the Indian Penal Code and sections 25(1-b)a, 26, 35 of the Arms Act.

As per allegation in the FIR, petitioner along with three accused persons was apprehended on spot, while they were trying to escape after seeing the police party. On search, two country loaded pistols having five cartridges were recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to

Police took the petitioner's signature on plain paper for being a witness of the seizure list but police has manipulated the seizure list in spite of making witness, police has named the petitioner as accused of the alleged seizure list. Petitioner is languishing in judicial custody since 17.07.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Barh, Patna in connection with Salimpur P.S. Case No. 133 of 2022.
