JUSTICE SHIVAJI PANDEY ORAL ORDER 15-06-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Mansahi P.S.Case No. 53 of 2014 registered u/s 393/34 IPC. As per the statement made in the FIR, while the informant after selling maize crops was going to Katihar on 16th June 2014 at 5:30 P.M., on way some unknown persons at the point of gun, tried to snatch the money. Name of petitioner surfaced in the statement of a co-accused. Petitioner is said to be in custody since 18th December 2014.

In the facts and circumstances of the case, petitioner Chhotu Poddar is directed to be released on bail on or after 18th July 2015, on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.16636 of 2015 (2) dt.15-06-2015 2/2 satisfaction of Chief Judicial Magistrate, Katihar in connection with Mansahi P.S.Case No. 53 of 2014, subject to the conditions that:

(i) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds and (ii) the petitioner would co-operate and if the petitioner will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
