JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 26-02-2021 The following reliefs as formulated by the petitioner have been claimed in the writ petition - "(i) To pay the C.P.F deducted with penal rate of interest along with normal rate of interest from 18.06.1984 to 05.08.1992 to the petitioner.

(ii) To pay the third ACP of petitioner.

(iii) To any other relief/reliefs for which the petitioner is entitled for."

2. None appears on behalf of the petitioner when the matter is called. The record shows that the petitioner had not appeared on past occasions on 19.06.2020, 25.08.2020, 22.09.2020, and 13.11.2020 either.

3. Learned counsel for the State appears and invites reference to paragraph-8 of the counter affidavit, stating inter alia that payment of C.P.F. Rs. 62,867/- with interest has been made to the petitioner for the period of 18.06.1984 to January 2019 by the concerned office/department in his S.B.I. account no. 11054560504 and the same is credited in his account.

4. As far as the claims towards 3rd ACP is concerned, it is submitted that no specific facts in this regard have been stated. In any event the matter would have to be verified by the District Account Officer, Rohtas, Sasaram.

5. Having regard to the repeated non-appearance on behalf of the petitioner and the stand of learned counsel for the State, the writ petition stands disposed of with liberty to the petitioner to file an appropriate representation replete with relevant details as regards claim for 3rd ACP, if so advised, before the Executive Engineer, Laghu Sinchain Pramandal, Kaimur, Mohania (respondent no. 4) within a period of three weeks hereof.
