JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and it appears from perusal of the impugned order that the name of this petitioner surfaced in this case on the basis of the confessional statement of co-accused Kundan Kumar. Admittedly, the aforesaid co-accused Kundan Kumar was granted privilege of bail by the learned Chief Judicial Magistrate, Vaishali at Hajipur itself but it is surprising and shocking that the prayer for bail of the petitioner was not only rejected by the learned Chief Judicial Magistrate, Vaishali at Hajipur but also by the learned Additional Sessions Judge II, Vaishali at Hajipur.

Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.16496 of 2015 (4) dt.10-09-2015 2/2 as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town No 07 of 2015.
