Learned counsel for the petitioner submits that the issue raised in the present writ application is covered by a judgment of the Hon'ble Division Bench in CWJC No. 19591 of 2016 and analogous cases decided on 17.05.2017. Learned counsel next submits that in the event, if the writ application is disposed of in terms of the order dated 17.05.2017 in CWJC No. 19591 of 2016 the petitioner would be satisfied. It is next submitted that against the order dated 17.05.2017 in CWJC No. 19591 of 2016 and other analogous

Patna High Court CWJC No.1897 of 2017(3) dt.28-02-2023 2/2 cases the petitioner of the said case had even moved before the Hon'ble Supreme Court by filing SLA (C) No. 36658/36659 of 2017 but the said SLA was dismissed by order dated 10.01.2018, it is next submitted that the order passed by the Division Bench of this Court stood affirm, it is thus submitted that the present writ application be also disposed of in the same terms, i.e., in terms of order dated 17.05.2017 in CWJC No. 19591 of 2016 and analogous cases (Saran Zila Mukhiya Sangh vs. The State of Bihar) the grievance of the petitioner shall stand redressed. Learned State counsel submits that she does not oppose the submissions made by the learned counsel for the petitioner.

In view of the submissions made by the learned counsel for the petitioner the present writ application is disposed of in terms of the order dated 17.05.2017 in CWJC No. 19591 of 2016.
