JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Laxmipur P.S. Case No. 219 of 2014, registered under Sections 307, 506, 341/34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3/4 of the Explosive Substance Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the petitioner was apprehended by the Police in connection with Laxmipur P.S. Case No. 38 of 2015 and Police got recorded the confessional statement of this petitioner showing his involvement and others in the present case, except the confessional statement there is nothing against the petitioner to show his involvement in the present case. The petitioner is accused in 16 other cases, as detailed in para-03 of the bail

Patna High Court Cr.Misc. No.9574 of 2016 (3) dt.28-04-2016 2/2 application. Further submission is that similarly situated coaccused Laldeo Yadav, Rahul Rao and Ganori Yadav have already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 20.08.2015 passed in Criminal Misc. No.34010 of 2015 and 15.02.2016 passed in Criminal Misc. No. 3986, respectively. The petitioner is in custody since 11.05.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Addl. District and Sessions Judge, Jamui in connection with Laxmipur P.S. Case No. 219 of 2014.

Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner and further the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
