2. In this case, the petitioners are seeking regular bail in connection with Barachatti P.S. Case No. 397 of 2023,

Patna High Court CR. MISC. No.2462 of 2025(2) dt.15-02-2025 2/3 registered for the offences punishable under Sections 392 of IPC.

3. As per prosecution case, when informant left the house for attending marriage ceremony, two unknown men overtook his bike and started assaulting him. They also looted his bike, mobile phone and Rs.1,000/- cash from the informant.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in the present case. He submits that the allegation against the petitioners are false and concocted. Nothing has been recovered from the possession of petitioner, Chinu Paswan, whereas petitioner Ramesh Kumar @ Satya is the bonafide purchaser of the mobile which was recovered from his possession. They are persons of clean antecedent. Petitioners are under custody since 08.10.2024.

5. Learned APP has vehemently opposed the prayer for bail of the petitioners.

Considering the above mentioned facts and circumstances and clean antecedent of the petitioners, let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- each with two surities of the like amount each to the satisfaction of learned A.C.J.M.-II, Sherghati (Gaya) in

Patna High Court CR. MISC. No.2462 of 2025(2) dt.15-02-2025 3/3 connection with Barachatti P.S. Case No. 397 of 2023, subject to the condition that the petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.

7. Before accepting the bail bonds, the criminal antecedent of the petitioners shall be verified and if, it is found that they are involved in any other case except the present one, their bail bonds shall not be accepted. (Nawneet Kumar Pandey, J) priyanka/- U T
