Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 29-09-2021 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 394/402 of the Indian Penal Code and Section 27 of the Arms Act.

Two unknown miscreants robbed the informant while he was going along with the petitioner. On the information of petitioner the case was lodged. However, during investigation it surfaced that named co-accused were involved in robbing and from their possession part of the looted money was recovered. One of them namely Pinku Kumar has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.23812 of 2021. The petitioner is also under suspicion. The petitioner is

Patna High Court CR. MISC. No.14262 of 2021(3) dt.29-09-2021 2/2 in custody since 01.09.2020. Investigation of the case is already complete.

Learned counsel for the informant opposed the prayer of bail.

Considering lack of sufficient material against the petitioner for further detention as under trial prisoner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Riga P.S. Case No. 258 of 2020 with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
