The petitioner seeks bail in a case under Sections 366 (A)/34 of the Indian Penal Code.

The informant made allegation that his daughter became traceless. During the course of enquiry, the informant was informed that his daughter was found going towards station along with Billal, his brother Shabbu and the petitioner (father of Billal). Learned counsel for the informant submitted that the victim is still traceless. The petitioner was also found along with the victim but from perusal of the F.I.R. itself, it appears that the informant is not an eye-witness of the occurrence. He did not disclose the name of the person from whom he came to know about the occurrence. When the informant visited the house of the petitioner, the petitioner was found present there. Patna High Court Cr.Misc. No.16301 of 2015 (3) dt.23-06-2015 2/2 being the father of co-accused Billal, who is alleged to have kidnapped the daughter of the informant, is in jail since 25.01.2015.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in Jamalpur P.S.
