The petitioner being the husband of the sister of the informant is languishing in custody since 09.01.2016 in a case registered for the offences punishable under sections 323/498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Basic accusation is of torture for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the sister of the informant and filed Matrimonial Suit No.164 of 2015 for restitution of conjugal rights. The petitioner is still ready to keep the sister of the informant as wife with dignity and honour. A

Patna High Court Cr.Misc. No.9025 of 2016 (2) dt.23-02-2016 2/2 statement to that effect has been made at paragraph 10 of the petition which reads as follows :- "10. That, petitioner always and still ready to keep her wife i.e. O.P. No.2 with full honor and dignity." Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Marhowrah P.S.
