The petitioner seeks regular bail in connection with Begusarai Nagar P.S. Case No. 497 of 2018, registered for the offence punishable under Sections 25(1-b)A, 26 and 35 of the Arms Act.

The allegation is regarding the police having apprehended the accused persons and as far as the petitioner is concerned, one loaded country made pistol was recovered. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and in fact, no recovery has been made from the conscious possession of the petitioner. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody

Patna High Court Cr.Misc. No.2474 of 2019(2) dt.18-01-2019 2/2 since 13.08.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on bail immediately upon completion of six months of custody i.e. with effect from 13.08.2018, subject to such conditions as may be imposed by the learned court of Chief Judicial Magistrate, Begusarai in connection with Begusarai Nagar P.S. Case No. 497 of 2018.

The present petition stands disposed of with the aforesaid directions.
