It appears that as per peremptory order dated 30.08.2016, this application stood dismissed. The learned counsel for the petitioner has drawn attention of this Court to the office note dated 22.09.2017 wherein it is reported that notices were being issued upon respondent nos. 1 to 42 under registered cover fixing date for hearing in admission matter on 09.11.2017. Office further reported that a letter was being issued to the learned Civil Judge, Senior Division-III, Samastipur for compliance of notices upon the said respondents. Office has further reported that the order dated 30.08.2016 not having been complied within the time prescribed by this Court, this writ application stood dismissed. On query, the office has reported that there was shortage of notice against the respondent no. 24.

Patna High Court CWJC No.12570 of 2014 (5) dt.01-05-2018 2/2 In the above facts and circumstances, this writ cannot be dismissed and it will be heard in due course. The petitioner is directed to file requisites for issuance of notice against the respondent no. 24, through registered cover with A/D within two weeks and on filing requisites, the same be issued against the respondents as per order dated 30.08.2016.
