1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Madhuban Police Station Case No. 198 of 2024, disclosing offences under Sections 341, 323, 324, 307, 34 of the Indian Penal Code.
3. As per the prosecution case, on 16.05.2024, while the informant was going towards his field in the morning, the petitioners surrounded and assaulted the informant in front of
Patna High Court CR. MISC. No.3233 of 2025(2) dt.20-02-2025 2/3 his house. Petitioner no. 1 gave knife blow on the head of the informant which was repeated by the petitioner causing injury on the chest and right hand of the informant.
4. Learned Counsel for the petitioner submits that the occurrence has taken place due to dispute regarding passage between the parties. The allegation against the petitioner no. 1 is that he assaulted the informant by knife which is a sharp cutting weapon but the injuries sustained by the informant are simple in nature caused by hard and blunt substance as would be evident from injury report at Annexure P/2.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are neighbors having dispute regarding passage and the injuries sustained by the informant are simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, East Champaran, Motihari, in connection with Madhuban Police
