JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-03-2019 The present application has been filed for modification of the order dated 14.12.2018 passed in Cr. Misc. No. 67917 of 2018 to the extent that this Court directed for the payment of Rs.3000/- per month to the complainant in pursuance of readiness of the petitioner from January, 2019 but it has inadvertently been recorded as January, 2018. This fact has been verified from the Court Master as well as the Secretary concerned that the payment was supposed to be made from January, 2019. Moreover, the said amount was directed to be deposited in the bank account of the complainant by second week of every succeeding month which suggests that the payment was directed to be made prospectively. Patna High Court CR. MISC. No.2399 of 2019(3) dt.14-03-2019 2/2 usually does not direct for such payment retrospectively. In the circumstances, the order dated 14.12.2018 passed in Cr. Misc. No. 67917 of 2018 stands modified to the extent that the petitioner is ready to make payment of Rs.3000/- per month from January, 2019.

Let the date of surrender of the petitioner be extended by further four weeks from today.
