JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-07-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

The present petition has been filed seeking modification of the order dated 09.09.2020 passed in Cr. Misc. No. 14649 of 2020 to the extent that the petitioner be exempted from appearing before the Officer-in-charge of the concerned police station on each Monday of the week.

The learned counsel for the petitioner has submitted that on account of the prevailing situation due to Covid 19 Pandemic, it is quite difficult for the petitioner to travel all the way to the police station to mark his attendance, more so since

some time lock down is also enforced by the State Government. The learned APP for the State Shri Chaubey Jawahar submits that the petitioner be directed to appear before the concerned Officer-in-charge till the framing of charge. Having regard to the facts and circumstances of the case and considering the prevailing situation due to Covid 19 Pandemic, I deem it fit and proper to modify the order dated 09.09.2020 passed in Cr. Misc. No. 14649 of 2020 to the extent that the petitioner shall now be obliged to mark his attendance before the Officer-in-charge of the concerned police station once a month, till the framing of the charges in the ongoing Criminal case before the learned court below.

The petition stands disposed of with the aforesaid modification in the order dated 09.09.2020 passed in Cr. Misc. No. 14649 of 2020.
