JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner and the State. The petitioner is languishing in jail since 15.11. 2s015 in a case registered for the offences punishable under Sections 20, 22, 25 and 29 of the N.D.P.S. Act. From the house of the petitioner 18 KG of Ganja were recovered.
It is submitted by learned counsel for the petitioner that the recovery, if at all, has been made from the joint family house. The recovery is between small and commercial quantity. Statement has been made in para 3 of the petition that the petitioner is accused in one other case registered under the provisions of N.D.P.S. Act wherein he is on bail. Patna High Court Cr.Misc. No.8544 of 2016 (4) dt.26-07-2016 2/2 submits that the 18 Kg of Ganja were recovered from the house of the petitioner.
Considering the quantity of recovery this court is not inclined to grant bail of the petitioner at present. Accordingly the prayer for the bail of the petitioner is rejected in connection with Special Case No. 17 of 2015 pending in the court of learned Sessions Judge, Araria.
