JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Special Case No. 234 of 2018 arising out of Athmalgola P.S. Case No. 231 of 2018 for the offenses under Sections 363, 366(A)/34 of the Indian Penal Code and Sections 8 and 10 of the POCSO Act. Referring to the statement of the victim under Section 164 Cr.P.C., learned counsel for the petitioner submits that the victim has acknowledged voluntary joining of wedlock with this petitioner.

Considering the fact that the victim has acknowledged the voluntary joining of wedlock with the petitioner and the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.3790 of 2019(2) dt.25-01-2019 2/2 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 1st cum Special Judge, POCSO Act, Patna in connection with Special Case No. 234 of 2018 arising out of Athmalgola P.S. Case No. 231 of 2018.
