2. The petitioner seeks bail in connection with Palasi P.S. Case No. 370 of 2024 dated 21.10.2024, instituted for the offence punishable under Sections 21(b), 21(c) of the N.D.P.S. Act, 1985.

3. The allegation is of recovery of total 26.300 litres cough syrup from the house of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner submits that the said recovery has been made from the semi-constructed house of the petitioner where labours were residing. It is further submitted that the police did not follow the conditions as laid down under Section

Patna High Court CR. MISC. No.2272 of 2025(2) dt.05-02-2025 2/2 103 of B.N.S.S., 2023. Lastly, it has been submitted that the petitioner is in custody since 22.10.2024 having no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge cum Spl. Judge, NDPS, Araria in connection with Palasi P.S. Case No. 370 of 2024.
