Heard learned counsel for the petitioner as well as learned A.P.P. for the State.
Earlier the petitioner was granted privilege of anticipatory bail with condition to deposit rupees two lacs in three installments but the petitioner failed to deposit the said amount and in the meantime he was arrested by the police. The petitioner being a rice mill owner lifted paddy and agreed to supply CMR and, accordingly, he supplied near about 5130.00 quintals of CMR but failed to supply 900.00 quintals of CMR worth Rs. 17,12,817.00. Learned counsel for the petitioner submits that the above stated fact clearly goes to show
Patna High Court Cr.Misc. No.9828 of 2016 (2) dt.01-03-2016 2/2 that the petitioner had no intention to cheat the Bihar State Food Corporation.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bikramganj, District Rohtas in Nasariganj P.S.
