2. The petitioner seeks bail in connection with Musrigharari P.S. Case No. 84 of 2020, registered for the offence punishable under Sections 120B/34, 302, 307, 326, 341 of the Indian Penal Code and Section 27 of the Arms Act.
3. This is the third attempt of the petitioner for grant of regular bail. Earlier the bail was rejected twice by this Court vide order dated 25.10.2021 passed in Cr. Misc. No. 19913 of 2021 and vide order dated 19.04.2023 passed in Cr. Misc. No. 15529 of 2023, with a direction to the trial court to conclude the trial within stipulated period.
4. Vide order dated 09.02.2024, a report was called for, regarding the stage of trial. In compliance thereof, a report
Patna High Court CR. MISC. No.9116 of 2024(3) dt.13-03-2024 2/3 sent by learned Additional District & Sessions Judge-IX, Samastipur dated 19.02.2024, is kept in flag 'A', whereby it is stated that at present the case is pending for defence evidence. In this case the prosecution has examined 11 witnesses and after closure of prosecution evidence statement of accused persons u/s 313 Cr.P.C., has also been recorded. Thereafter, the record is fixed for defence evidence and the defence has also examined 12 witnesses so far. However, during the course of defence evidence, on petition filed by one of the co-accused persons, the learned Predecessor Court vide order dated 21.06.2023, passed the order of examination of informant, Maheshwar Ray, on behalf of defence and in the light of the said order the informant has also been cross-examined on 18.
10.2023. Thereafter, the record is pending for defence evidence. Out of five accused persons, defence evidence on behalf of four accused persons have been closed on 17.02.2024. The case record is pending for adducing defence evidence on behalf of one accused Ravi Ray @ Ravi Rai.
5. Considering the submissions made in the report, I am not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is hereby rejected.
6. However, the trial court is directed to conclude the
Patna High Court CR. MISC. No.9116 of 2024(3) dt.13-03-2024 3/3 trial as expeditiously as possible, preferably within a period of six months from the date of receipt/production of a copy of this order.
