The petitioner apprehends his arrest in connection with Begusarai Muffasil P.S. Case No. 362 of 2019, registered under Section 30(a) of the Bihar Excise Act, 2016. The accusation is that on receiving secret information about keeping of illicit liquor by Navin Yadav in Hanuman Lane, the informant along with other police personnel reached there. On seeing the police party, several persons present in the Varamdah of Navin Yadav started to flee away, while they were chased but succeeded to flee away. On search of the house of Navin Yadav, several bottles of Indian made foreign liquor in the volume of 507.37 litres recovered and the

Patna High Court CR. MISC. No.2975 of 2020(2) dt.04-02-2020 2/2 truck was found parked near his house. On query, the persons present there disclosed that the aforesaid bottles of liquor were unloaded from the truck and also disclosed the name of eight persons including the petitioner, who succeeded to flee away. Learned counsel for the petitioner submits that petitioner was not apprehended at the spot, in fact, he is accused in two other cases in similar nature due to that reason, police implicated him in the present case, while nothing has been recovered from his possession.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai, in connection with Begusarai Muffasil P.S. Case No. 362 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
