Heard learned counsel for the petitioners and learned A.P.P. for the State, Shri Rabindra Kumar. 2.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 127(1), 115(2), 118(1), 352, 109, 351(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of Arms Act.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 2-10-2024 at 5:30 am, Jaynendra Singh was throwing cow-dung in front of his house and when informant objected, it is alleged that Jaynendra Singh threatened, further

No.3131 of 2025(3) dt.12-05-2025 2/3 Dhananjay Kumar is alleged to have assaulted the informant with bhala causing injury on back side of his head, thereafter Dinkar Kumar assaulted his brother with katta and when wife of the informant came to save her husband, Jayanand assaulted her, thereafter Dinkar fired and fled away.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that petitioners and the informant are related and are having dispute relating to property. It is further submitted that on a trivial issue, an altercation took place in which both sides assaulted each other. It is also submitted that the injury suffered by the injured is simple in nature, which amply demonstrates that petitioners never had any intention of committing a serious occurrence. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners, but then fairly submits after perusing the case diary that the injury suffered by the injured is simple in nature.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on
