JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 Petitioner seeks regular bail in connection with Excise Case No. 338 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

Recovery of huge quantity of liquor i.e. 387.900 liters from the Scorpio vehicle and petitioner was found sitting in the vehicle with the driver.

Submission of the learned counsel for the petitioner is that he is not the owner of the vehicle. He was only a passenger, has been implicated only on suspicion. He is in custody for three and half months. Charge sheet has already been submitted, as such, there is no chance of tampering with the evidence Heard learned A.P.P. also.

Having heard both sides, in view of the submissions,

No.1642 of 2020(2) dt.14-01-2020 2/2 made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-II, Gopalganj, in connection with Excise Case No. 338 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.

It is also made clear that before releasing the petitioner on bail, address of the petitioner as well as address of the bailor must be verified by the learned Special Judge. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
