On account of burst of rear tyre of a vehicle a lady sustained injury and on account thereof, villagers rushed, apprehended Sanjay Prasad, Khalasi while informant Awadhesh Sah, driver managed to escape. The Khalasi was apprehended by the petitioner Shambhu Sah along with his brother Rambhu Sah and others. On 04.10.2013, when the informant came along with owner of the vehicle he found his brother dead.
Contention on behalf of petitioner is that specifying the petitioner and his brother is indicative of false implication otherwise there was no occasion for the informant to identify the petitioner and his brother only being an outsider. Apart from this, there happens to be omnibus allegation. Petitioner also happens to be under custody since 19.07.2014.
Patna High Court Cr.Misc. No.17155 of 2015 (2) dt.01-05-2015 The learned Additional Public Prosecutor opposed the prayer.
Accordingly, petitioner Shambhu Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned SDJM, Raxaul at Motihari in connection with Chhauradano P.S.
