JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 22-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Ishipur (Barahat) P.S. Case No. 23 of 2014 registered for the offences punishable under sections 25(1-B)(a) and 26 of the Arms Act. One country made pistol and five live cartridges are alleged to have been recovered from the possession of the petitioner.

It has been contended that the petitioner is in custody since 01.04.2014 and till date only three witnesses have been examined on behalf of the prosecution. There are several other witnesses yet to be examined in the case. The last witness was examined on 19.01.2015 and since then no other witness has

Patna High Court Cr.Misc. No.17173 of 2015 (2) dt.22-04-2015 2/2 turned up to depose on behalf of the prosecution. It has further been contended that the petitioner is innocent and has become the victim of high-handedness of police.

Learned counsel for the State has opposed the prayer for bail.

Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kaushal Kishore, Judicial Magistrate 1st Class, Naugachia at Bhagalpur in connection with Ishipur (Barahat) P.S. Case No.23 of 2014.
