The petitioner apprehends his arrest in Dinara P.S. Case No.275 of 2019 registered under Sections 304(B), 201 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Similarly situated co-accused Jwala Singh @ Saroj Kumar Patel has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 18.12.2020 passed in Cr.Misc.No.22025 of 2020 (Annexure 5). The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case as well as the fact that similarly situated co-accused

Patna High Court CR. MISC. No.14759 of 2021(2) dt.20-12-2021 2/2 has already been granted anticipatory bail, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Rohtas, Sasaram in connection with Dinara P.S. Case No.275 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
