Petitioner seeks bail in a case under Sections 364/34, 498A IPC and section 3⁄4 of the D.P. Act..

The mother of the victim made allegation that the petitioner, husband of her daughter, burnt her daughter, namely, Chanda but during the course of investigation, the witnesses have stated that the deceased was asking her husband not to bring medicine for his mother and due to such quarrel, the victim bolted herself in side the room and burnt herself. Except the informant and her family members, nobody has stated that the victim was being tortured by her husband. Even the Investigating Officer found that the house was locked from in side.

Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Birpur at Supaul in connection with Birpur (Bhimnagar) P.S.Case No.128 of 2013.
