A supplementary show-cause after service is filed which is taken on record.

The application alleges wilful/deliberate disregard/ disobedience of the order dated 09.08.2016 passed in CWJC No. 23267 of 2013 whereby the Director, Agriculture Department, Govt. of Bihar was directed to consider the representation filed by the petitioner and take appropriate decision thereon in accordance

Patna High Court MJC No.3861 of 2016 (5) dt.15-03-2017 2/2 with law.

In paragraph no. 6 of the show-cause, it is stated that a report of the enquiry team was submitted on 6.3.2017 whereon, after consideration, the District Agriculture Officer, Buxar has already been directed to ensure payment of the subsidy to the petitioner. By another communication dated 06.03.2017, the Joint Director (Agronomy), Patna Division, has also been directed to take appropriate action against the erring officer. On the basis thereof, it has been submitted that a decision has already been taken as required under the said law by the concerned opposite party.

Considering the above, the present proceeding does not need further persuasion. It is expected the admissible dues as per the direction of the Director Agriculture Department, if any, shall be made in favour of the petitioner.

Dismissed.
