The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 325, 354, 447, 379, 504, 506/34 of the Indian Penal Code.
The prosecution case as per F.I.R is that all the F.I.R named accused persons assaulted the informant and his nephew, as a result of which, they sustained injuries.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.3652 of 2022(2) dt.01-08-2022 2/3 petitioners that in the background of some land dispute, the present F.I.R has been registered. The petitioners were not named in the F.I.R and their names transpired during investigation. It is further submitted that at earlier point of time, the petitioners' side lodged Sonbarsa P.S. Case No. 109 of 2020 against the informant and others. Hence, in order to put pressure upon the petitioners, this false case has been registered against the petitioners. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.
In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IVth, Sitamarhi in connection with Sonbarsa
