JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2021 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. A supplementary affidavit has been filed on behalf of the petitioner for bringing on record the fact that the husband of the deceased has already been acquitted by the Trial Court. The same be kept on record.

The petitioner is apprehending his arrest in a case registered under Sections 498(A), 307, 34, 304(B) of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

Allegation against the accused persons is of committing torture and assault and thereafter caused death of the victim due to non-fulfilment of demand of dowry. It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.1777 of 2020(3) dt.30-09-2021 2/2 the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is father-in-law of the deceased. He is separate in mess and property from the husband of the deceased. The petitioner has got no concern with the alleged occurrence.

On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram in connection with Sasaram Nagar P.S. Case No. 732/19, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) Pankaj/- U T
