The petitioner seeks bail in a case registered for the offences punishable under section 7 of the Essential Commodities Act.
The petitioner is alleged to be driver of the pick up van from which 70 bags of rice weighing 30 quintals were seized. At the time of seizure the petitioner disclosed that the aforesaid pick up van belonged to Mahendra Chaudhary, who happened to be the P.D.S. dealer. Petitioner is in jail since 24.12.2015. Except one case under section 498-A of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act, petitioner does not have any criminal antecedent.
Patna High Court Cr.Misc. No.10264 of 2016 (2) dt.03-03-2016 Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Begusarai in connection with Phulwariya P.S. Case No. 181 of 2015.
