====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 17-06-2015 Heard both sides.

The petitioner seeks bail in a case registered under Section 302 and other sections of the Indian Penal Code. Indal Devi named Nathuni Sah, Shankar Sah, Anju Devi and Merkhun Devi (the petitioner) and alleged that all the four accused persons assaulted her. When her son Om Prakash came to save her, Nathuni Sah and Shankar Sah assaulted her son Om Prakash with fists and slaps as a result of which her son became unconscious and died on the spot. It appears that the informant has not made any allegation that the petitioner assaulted his son on account of which he died. The informant did not get any apparent injury. The petitioner is not the assailant of the deceased.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.19762 of 2015 (2) dt.17-06-2015 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Minapur P.S.
