Mr.Shailendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Kinjar P.S. Case No. 12/2018, instituted for offences under Section(s) 341, 323, 504, 304(B), 201 and 34 of the Indian Penal Code.

Petitioner is the husband of deceased.

It is alleged in the written report that the deceased (daughter of informant) was married with this petitioner in the year 2010 according to Hindu rites and custom. One son and daughter were born from the wedlock. The deceased was tortured by this petitioner and his family members for demand of dowry for which Arwal Mahila P.S. Case No. 05/2015 was filed under Section 498A of the Indian Penal Code against petitioner. In the aforesaid case petitioner was granted bail on the basis of compromise. Daughter of informant was living in her Sasural. In the meantime, informant learnt that his daughter is ill. Thereafter informant and his son went

Patna High Court CR. MISC. No.2614 of 2019(3) dt.29-03-2019 2/3 to Sasural of his daughter and learnt that his daughter has been done to death in her Sasural and her dead body has been disposed off. He found that the accused persons had fled away after putting lock in the house.

Case diary has been received.

In case diary there is no any evidence that this petitioner had informed the informant about the death of the deceased and her family members had refused to participate in the cremation of the deceased.

From case diary, it appears that deceased died in her Sasural in suspicious circumstances and her dead body had been disposed off without intimation to the informant. Considering the aforesaid facts and circumstances, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected. The trial court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of nine months from the date of receipt of this order. Petitioner will be at liberty to renew the prayer for bail after nine months in the event no substantive progress is made in trial.
