The petitioner apprehends his arrest in connection with Rahui (Wena) P.S. Case No. 305 of 2021 registered under Sections 409 and 420/120(B) of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The first information report is lodged after lapse of three weeks. Further he submits that the petitioner is not responsible for supplying substandard quality of rice, since sample of rice was not taken from the godown of the petitioner's firm rather the sample was taken either from the

It is also submitted that the letter of the District Magistrate itself clearly reveals that there has been a gross negligence by the District Manager, State Food Corporation in obtaining the CMR in Nalanda District due to which substandard rice was received and supplied to another district. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Magistrate, Patna in connection with Rahui (Wena) P.S. Case No. 305 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
