Petitioner is in custody in connection with Harsidhi P.S. Case No. 226 of 2019 for the offence under sections 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that allegation against this petitioner is that he has looted the motorcycle of the informant on the pistol point. Petitioner was not named in the FIR. His name surfaced on the confessional statement.

Learned counsel submits that there is no incriminating article was recovered from the possession of the petitioner. Although he was named in the FIR yet he has not been put on TIP.

Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Harsidhi P.S. Case No. 226 of 2019.

On release, the petitioner is required to tender his service as volunteer in order to combat with the corona virus, he is required to report to the Civil Surgeon, Motihari, East Champaran who shall take appropriate steps for utilization of service of the petitioner as volunteer.
