JUSTICE PRABHAT KUMAR JHA ORAL ORDER 13-04-2015 Heard both sides. The petitioner seeks bail in Akbarpur P.S. Case No. 291 of 2014, registered under Sections 420, 467, 468 and 471 of the I. P.C.

The Senior Branch Manager of Punjab National Bank Branch- Akbarpur, Nawada, alleged that the petitioner deposited a cheque bearing No. 199600 of Rs. 3,45,400/- in his account. The said cheque was issued by Alchemist Infra Reality Ltd. The petitioner came to the Bank for withdrawing the amount but by that time, the Branch Manager of the said bank, received information from Alchemist Infra Reality Ltd., that the aforesaid cheque was of Rs. 5000/- and the same was issued in the name of

Patna High Court Cr.Misc. No.7310 of 2015 (3) dt.13-04-2015 2 / 2 Praveer Kumar Biswas. The cheque was not handed over to him. The petitioner was apprehended inside the bank itself when he had come to withdraw the amount from his account. It appears that the petitioner withdrew Rs.49000/- from his account and when he was making effort for withdrawing the entire amount the petitioner was apprehended.

Considering the facts that the petitioner obtained a duplicate forged cheque of Rs. 3,45,400/- and got the same credited in his own account and thereafter tried to withdraw the entire amount, I am not inclined to enlarge the petitioner on bail in Akbarpur P.S. Case No. 291 of 2014, pending in the court of the learned C.J.M., Nawada.

The Trial Court is directed to expedite the trial and conclude the same within nine months from the date of receipt of this order.
