The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 498 (A), 341, 323, 504, 506 & 34 of the Indian Penal Code and 3⁄4 of the D.P. Act.
Learned counsel for the petitioner submits that earlier in this case, the petitioner was directed vide order dated 16.01.2020 is that petitioner is ready to keep his wife. The petitioner approaches the O.P. No. 2 along with S.H.O., Nathnagar and persuade her to reside with the petitioner and the case was directed to be listed today i.e. on 03.02.2020 in Chamber at 4:15 P.M.

No.2159 of 2020(3) dt.03-02-2020 2/2 Learned counsel for the petitioner has submitted that in view of the direction, he went alongwith S.H.O. to persuade the Opposite Party No. 2 but family members of the Opposite Party No. 2 intentionally went away somewhere locking the door, he is still ready to keep her with dignity and care. Learned counsel for the informant/ O.P. No. 2 submits that she is appeared and not ready to reside with the petitioner. In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No. 441 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
