2. The petitioner apprehends her arrest in a case registered for the offence under Section 306 of the Indian Penal Code.

3. The complainant Ramesh Sharma has alleged that his son Kundan Kumar was married with petitioner Joli Kumari in the year 2015 and after the marriage, the behaviour of Juli was not proper. She always used to quarrel and fight with Kundan Kumar and other family members to avoid household work and for other reasons. It is further alleged that due to illtreatment and harassment by the petitioner and others, his son committed suicide by consuming Salphos and left a suicide note that being fed up with abuse and torture by petitioner and other

4. Learned senior counsel for the petitioner submits that petitioner is wife of the deceased. Petitioner was married with deceased in the year 2015. At the relevant time i.e. on 12.05.2019, this petitioner was serving her mother, who was admitted at IGIMS, Patna and was discharged on 15.05.2019 and thereafter, petitioner brought her mother at her Maika to look after her and as such, on the date of occurrence, she (petitioner) was at her Maika. He further submits that there is no material to show that this petitioner instigated or abated the deceased to commit suicide. There is no allegation of any direct or active act against this petitioner leading the deceased to commit suicide.

Police after investigation submitted final form, however differing with the same, learned Court below took cognizance on the protest petition, filed by complainant. He next submits that during pendency of the case good sense prevailed between the parties and thereafter, a compromise petition has been filed in the Court of learned A.D.J.-III, Patna City, Patna, which is kept at Annexure P/6 to the petition. Petitioner is lady and has got clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Patna City, Patna in connection with Shahjahanpur P.S. Case No. 46 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
