JUSTICE GOPAL PRASAD ORAL ORDER 31-07-2015 These two criminal miscellaneous applications have been heard together and are being disposed off by this common order.

Heard the learned counsel for the petitioners and the State.

This is a petition for grant of regular bail for offence under Sections 395 and 397 of the Penal Code.

There is allegation of snatching of pistol from police personnel and it is strange that the said pistol was recovered from the house of petitioners, however, it appeared that the petitioners were well

Patna High Court Cr.Misc. No.18841 of 2015 (4) dt.31-07-2015 known to the informant (police personnel) and it is highly improbably that the persons known to the police personnel will snatch their pistol and there is no allegation that the petitioners were accused or extremists. The police personnel were making some indecent remarks to one Puja Kumari Rani for which a protest has been made, but, it may be the defence of the accused.

Hence, having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Beur P.S. Case No. 30 of 2015 to the satisfaction of the Chief Judicial Magistrate, Patna.
