The petitioner seeks regular bail in connection with Suryagarha P.S. Case No. 228 of 2018 instituted for the offences under Sections 302, 394 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.10.2021, charge-sheet has been submitted in the case and has antecedent of 6 cases. Learned counsel for the petitioner submits that petitioner is named in the First Information Report, and general allegation about the assault to Parmanand Yadav but there is no injury on the body of Parmanand Yadav.

No.5166 of 2022(2) dt.08-06-2022 2/2 As per written report, specific allegation of causing firearm injury on head of Dewar of the informant, Bipin Yadav, is against Bhikhari Singh. Dewar of the informant subsequently died. There is a general and omnibus allegation against all accused persons except Bhikhari Singh. It is further submitted that other co-accused namely Munna Singh and Dani Singh have been granted bail by a Sub-ordinate Bench of this Court vide order dated 24.04.2019 and 17.08.2019 passed in Cr. Misc. No. 26540 of 2019 and 29599 of 2019 respectively. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 03.10.2021, charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Lakhisarai in connection with Suryagarha P.S.
