Petitioner, who is in custody, seeks bail in connection with Bidupur P.S. Case No. 35 of 2018 registered for the offence punishable under Sections 341, 323, 324, 325, 307, 379, 504, 506 of the Indian Penal Code and 27 of Arms Act. Informant has stated that his son was coming from Patna on 16.02.2018 and sat on a Bolero Jeep which was also going towards Mahnar, however in the way, three miscreants were sitting in the vehicle started assaulting his son and also snatched Rs. 10,000/-, mobile, ATM cards Adhar card from his possession and on protest they fired upon his son, causing firearm injury on his shoulder.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.2625 of 2019(2) dt.24-01-2019 2/2 he has been implicated in this case only on the basis of confession made by co-accused Kunal Kumar and except said confession, there is no incriminating material against the petitioner. He has not been put on TIP nor any looted article has been recovered from his possession. Petitioner is in custody since 17.05.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIV, Vaishali at Hajipur, in connection with Bidupur P.S. Case No. 35 of 2018 subject to the conditions that:-
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and his absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel his bail bond.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
