Petitioner seeks bail in a case registered under sections 399, 402, of the Indian Penal Code and 25(1-b)a, 26 of the Arms Act.

According to the prosecution case the officer in charge of Pandarak P.S. received information that 6-7 persons were assembled with arms in the Neem Ghat on the bank of Ganga at village Pandarak. Having entered Sanha, the informant proceeded with police force and reached the Neem Ghat, the culprits started running away after seeing the police jeep, but one of them was apprehended on chase, who disclosed his name as Manas Kumar in presence of two witnesses and one country made

Patna High Court Cr.Misc. No.21161 of 2015 (2) dt.13-07-2015 2/2 pistol and four live cartridges were recovered from his possession. The arrested accused disclosed the name of other accused persons including the petitioner. Thereafter first information report was lodged.

It has been submitted on behalf of the petitioner that petitioner is in custody since 04.02.2015 and charge sheet has been submitted in this case. It is further submitted that petitioner has been named by the co-accused in the present case. It has further been submitted that the petitioner be released after completion of nine months in custody from 04.02.2015. On behalf of the State it is submitted that petitioner is name in the first information report. Considering the aforesaid facts, It is directed that the above named petitioner be enlarged on bail after completion of nine months in custody from 04.02.1015 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of A.C.J.M, Barh in Pandarak P.S. Case No. 135 of 2014.
