JUSTICE GOPAL PRASAD ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 01.01.2016 in connection with Bihar P.S. Case No. 577 of 2015 registered for the offences punishable under Sections 461/379 and 411/413/414 of the Indian Penal Code.

Prosecution case in brief is that on 27.11.2015, the informant, in his written report has alleged that he has his electronic shop situated in Biharsarif, which in usual course of action he closed on 26.11.2015. On the very next morning, when he reached to his shop for opening it, he found that the back wall of the shop was broken and 15 television sets worth Rs.4,50,000/- were stolen.

Patna High Court Cr.Misc. No.8837 of 2016 (2) dt.18-03-2016 2/2 Learned counsel for the petitioner submits that from a bare perusal of the F.I.R. it would be evident that the petitioner has not named in the F.I.R and the case is made out against unknown persons.

Considering the aforementioned facts and circumstances, the period of custody and also that the petitioner has no antecedent, let the petitioner above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, in connection with Bihar P.S.
