The petitioner has been arrested in connection with Bihar P.S. Case No. 437 of 2015 registered for offence under Sections 341, 323, 504, 506 and 307/34 of Indian Penal Code. It is alleged that petitioner along with other co-accused persons came to the house of the informant and threatened to withdraw the case levelled against them, then the informant refused the same. Thereafter, the petitioner along with others accused persons assaulted the informant and his two sons by means of lathi, danda bricks etc.
Learned counsel for the petitioner submits that petitioner is son-in-law of Raja Paswan one of the co-accused in this case
Patna High Court Cr.Misc. No.8773 of 2016 (2) dt.15-03-2016 and there is general and omnibus allegation levelled against him. Learned counsel for the State however opposed the prayer for bail of the petitioner on the ground that occurrence took place to pressurise the informant to withdraw the case pending against the petitioner since before the occurrence.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Bihar P.S. Case No. 437 of 2015, subject to condition that petitioner will not indulge in such activity to pressurise any witness and if any such allegation levelled against the petitioner in future, the trial court itself cancel the bail bond of the petitioner. m.p.
