The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegations in the FIR, 3800 litres of sprit was recovered from the vehicle being driven by this petitioner. It is submitted by learned counsel for the petitioner that no incriminating article was recovered from his possession or vehicle. He has been falsely implicated in the case. He is only the driver of the truck and did not know about the contents of the goods loaded. He is in custody since 31.10.2020 and has no criminal antecedent.

No.14206 of 2021(3) dt.24-08-2021 2/2 Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent and having remained in custody for over 9 months, the Court directs the petitioner to be enlarged on bail in connection with Excise Case no. 891 of 2020 (arising out of Kaler P.S. Case no. 52 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II, Jehanabad.
