The petitioner is apprehending his arrest in connection with Katoria P.S. Case No. 209 of 2016, registered for offences punishable under Sections 341, 323, 353, 504, 506 and 379 of the Indian Penal Code.
The petitioner is named in the FIR and allegation against him is that he has demanded money from the informant, who is a Principal of a Primary School and also abused and assaulted him.
It has been submitted on behalf of the petitioner that no case is made out under Section 379 IPC as there is no allegation that the petitioner has taken away anything. Heard learned A.P.P. also.
Having heard both sides and in view of the
Patna High Court Cr.Misc. No.14457 of 2017 (4) dt.20-04-2017 2/2 allegations as made in the FIR, it is not a fit case for grant of anticipatory bail, rather, the petitioner should surrender and pray for regular bail before the Court below which will be considered without being prejudiced by the order of this Court. The application is, accordingly, dismissed.
