The petitioner seeks bail in connection with Buxar (Ind) P.S. Case No. 139 of 2020 registered for the offences punishable under Sections 498A, 365/34 of the Indian Penal Code read with Section 3/4 of Dowry Prohibition Act and later on, Section 304(B) and 201 of the IPC have been added. The learned counsel for the petitioner submits that the petitioner is in custody since 01.12.2021, charge-sheet has been submitted in the case and is a person with clean antecedent and is the mother-in-law of the deceased and the husband is in custody and the informant alleges that his daughter was married to Tarkeshwar Choudhary in the year 2019 and out of the wedlock one child was born, it is next alleged that after

No.3647 of 2022(2) dt.26-05-2022 2/3 marriage petitioner along with other accused persons used to torture the daughter of the informant on the pretext of dowry and further her husband had an illicit relation with another girl of his village on account of which quarrel used to take place between daughter of the informant and her husband, it is next alleged that on 02.08.2020 the husband of the deceased called the informant and asked him to fulfill the damage which has occurred on account of quarrel as the deceased had broken the mobile, it is next alleged that on the same day i.e. 02.08.2020 the husband of the deceased informed that her daughter is missing.
The learned counsel submits that from perusal of the allegation as alleged in the FIR it would manifest that thrust of the allegation is against the husband of the deceased, as far as the present petitioner is concerned, she is mother-in-law and there is general and omnibus allegation of demand of dowry. The learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case and is mother-in-law and the husband is in custody, let the petitioner above named be released on bail on furnishing
