The petitioner apprehends his arrest in connection with Nathnagar (Madhusudanpur) P.S. Case No. 429 of 2019, registered under Section 30(A) of the Bihar Excise Act, 2019. The accusation is that on receiving secret information about carrying the illicit liquor towards Bhatodiya by Prashant Kumar (petitioner) and Amarjit Choudhary, the informant along with other police personnel started checking at Biharipur More then a Hundai Car was seen. On giving signal to stop the car, two persons sitting in the car succeeded to flee away leaving the Hundai Car. On search of Hundai car bearing registration no. BR 10M 5665, 157 bottles each containing 750

Patna High Court CR. MISC. No.3655 of 2020(2) dt.04-02-2020 2/2 ml and 48 bottles each containing 375 ml Indian made foreign liquor recovered.

Learned counsel for the petitioner submits that petitioner is neither the owner nor the driver of the seized vehicle but due to dirty village politics, his name has surfaced in the present case. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge (Excise Act), Bhagalpur, in connection with Nathnagar (Madhusudanpur) P.S. Case No. 429 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
